In an unprecedented and historic ruling, the Administrative Court overturned the Medical Liability Authority’s decision to refer a doctor to the Public Prosecutor’s Office for practising without a licence and revoked the administrative penalty imposed on him.

Reversal of the Medical Liability Authority’s decision to refer a doctor to the Public Prosecutor for practising without a licence
and reversal of the administrative penalty imposed on him for not having an informed consent form.
The events date back to 2023, when the Deputy Minister of Health referred a complaint submitted by an individual to the Medical Liability Authority and formed a committee to investigate the complaint. The committee issued the following decision:
1- Referring one of the doctors to the Public Prosecution for practising without a licence from the Health Licensing Department.
2- Amending the penalty imposed for not having informed consent forms to KD 500 (five hundred Kuwaiti dinars).
The Administrative Court then overturned the Medical Liability Authority’s decision.
