Following the defence led by Lawyer Aisha Al-Shayji, the court rejected a compensation claim of KWD 150,000 (One Hundred and Fifty Thousand Kuwaiti Dinars) brought against a Kuwaiti doctor.

  • Following a robust defence led by Lawyer Aisha Al-Shayji, the court dismissed a compensation claim of KWD 150,000 brought against a Kuwaiti doctor.

 

  • The claim had been initiated after the Medical Liability Authority initially concluded that the doctor was negligent, allegedly resulting in the patient’s death. Acting on behalf of the defendant, Al-Shayji Legal Group challenged the findings of the medical report, raising substantive objections, including the absence of a causal link between the alleged negligence and the patient’s death.

 

  • Upon consideration of these objections, the Honourable Court referred the matter back to the Medical Liability Authority for further review. Following a comprehensive reassessment, the Authority concluded that no negligence or fault could be attributed to the doctor.

 

  • In light of these findings, the Court issued its judgment dismissing the claim in full and ordered the plaintiffs to bear the legal costs and fees.
